Terms and Conditions

Welcome to iSmart Lebanon ("the Company," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our e-commerce platform, website, mobile applications, and specialized services (collectively, the "Platform").

By creating an account, browsing the marketplace, listing products, or purchasing goods as either a retail buyer ("Buyer") or a third-party merchant ("Seller"), you explicitly agree to be legally bound by these Terms. If you do not agree to these terms, you must immediately cease using the Platform.

1. Marketplace Structure and Account Registration

A. Platform Definition

iSmart Lebanon operates an online e-commerce marketplace. We sell products directly and provide a multi-vendor ecosystem where independent third-party Sellers can manage storefronts and list inventory via a dedicated Seller Panel.

Eligibility & Account Security

You must be at least 18 years old or possess legal business credentials in Lebanon to register an account.

You are entirely responsible for safeguarding your account access credentials (username, password, and API tokens). Any transaction, inventory modification, or communication executed through your portal will be legally attributed to you.

We reserve the right to suspend or terminate accounts that provide fraudulent, incomplete, or outdated information during the registration process.

2. Terms of Purchase and Transactional Currency

A. Dual-Currency Support

To accommodate the local economic landscape, the Platform natively supports transactions in both United States Dollars (USD) and Lebanese Pounds (LBP).

 Final totals displayed at the checkout panel represent the exact legal invoice amount.

 If paying via Cash on Delivery (COD), the Buyer agrees to pay in the specific currency selected during the checkout phase unless a dynamic alternative rate is explicitly authorized by our logistics department prior to fulfillment.

B. Order Acceptance & Pricing Errors

The receipt of an electronic order confirmation does not signify our final acceptance of an order. We and our network of Sellers reserve the right to decline or limit order volumes for any reason.

In the event that a technical anomaly causes an item to be listed at an incorrect price or with erroneous specifications, we reserve the right to cancel pending transactions associated with that item and issue a full refund in the original currency.

3. Shipping, Logistics, and Delivery

Fulfillment Mapping: Orders placed on the Platform are fulfilled either by iSmart Lebanon’s central distribution warehouse or directly by independent third-party Sellers.

Delivery Timelines: Stated delivery windows are estimates. While we partner with premium domestic courier services across Lebanon, we are not liable for delayed shipments caused by regional logistics disruptions, roadblocks, or force majeure events.

Risk of Loss: Risk of loss and title for physical hardware passes to the Buyer upon delivery of the merchandise to our designated courier network.

4. Split Liability: iSmart vs. Third-Party Sellers

Because our platform functions as a shared marketplace, distinct boundaries exist regarding product liability:

Direct Inventory: Products explicitly sold and dispatched directly by iSmart Lebanon are fully backed by our technical diagnostics division and standard warranty paths.

Third-Party Inventory: For goods listed by independent merchants through the Seller Panel, the Seller assumes primary legal and commercial liability for product authenticity, accurate description parameters, and structural compliance.

Marketplace Intermediation: iSmart Lebanon acts as an administrative moderator. While we monitor marketplace quality, we do not guarantee the structural performance, safety, or legality of items listed by independent third-party vendors.

5. Warranties, Returns, and Software Validations

All user transactions are strictly bound by our standalone Refund and Return Policy. Key technical limitations include:

DOA Windows: Returns and exchanges are primarily restricted to Dead on Arrival (DOA) scenarios and must be filed within the authorized timeframe.

Digital & Software Constraints: Microsoft Windows, Office, and generic digital licensing tokens are completely exempt from returns and must be validated/activated on the exact day of purchase.

Firmware Disclaimers: Minor firmware or pre-installed software updates implemented by global component suppliers (e.g., updates to Tuya or Zigbee ecosystems) do not constitute a product mismatch if the underlying physical hardware matches the ordered model.

6. Enterprise Data Disclaimer

⚠️ Technical Data Loss Clause

> iSmart Lebanon, its engineers, and platform infrastructure owners are not legally or ethically responsible for any data loss, corruption, or hardware storage degradation (including HDDs, SSDs, and NVMe drives) occurring during device maintenance, network testing, or integration configurations.

> Users and corporate clients assume full responsibility for maintaining comprehensive, redundant external data backups prior to engaging our technical support infrastructure.

7. Prohibited Platform Activities

Users, Buyers, and Sellers are strictly prohibited from engaging in the following actions:

Disintermediation: Attempting to bypass platform transaction fees by contacting marketplace users directly to orchestrate off-platform orders.

System Abuse: Deploying automated scraping tools, bots, or script injections to manipulate inventory pricing, extract consumer data, or compromise the Seller Panel API.

Illicit Merchandising: Listing counterfeit electronics, stolen telecommunication gear, or hardware that violates Lebanese Ministry of Telecommunications licensing frameworks.

8. Limitation of Liability and Indemnification

To the maximum extent permitted by applicable law, iSmart Lebanon shall not be held liable for any indirect, incidental, punitive, or consequential damages arising out of your use of the Platform, including but not limited to loss of business revenue, network downtime, or hardware installation failures.

You agree to indemnify and hold harmless iSmart Lebanon, its directors, and technical associates from any third-party claims, liabilities, or losses stemming from your breach of these Terms or your infringement of third-party intellectual property rights.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the commercial and civil laws of the Republic of Lebanon. Any disputes, claims, or legal proceedings arising out of or relating to platform transactions shall be subjected to the exclusive jurisdiction of the competent courts in Nabatieh, Lebanon.

10. Modifications to Terms

We reserve the right to amend, update, or rewrite these Terms and Conditions at any time to reflect software evolutions, legislative shifts, or marketplace expansions. Continued utilization of the Platform following a posted terms revision indicates complete acceptance of the updated framework.
